Automobile liability insurance coverage (a/k/a “Compulsory Automobile Insurance”) is required by law with the following minimum limits (for personal/private-use vehicles) in the United States Virgin Islands for every registered vehicle:
Bodily Injury: 10,000 per person / Max 20,000 per accident
Property Damage: 10,000 per accident
 



 
 
 
Automobile liability insurance is financial protection for a driver and/or registered vehicle owner, who, while operating a vehicle, harms someone else or their property. Automobile liability insurance only covers injuries or damages to third parties and their property, not to the driver or the driver's property.

The two types of coverages for automobile liability insurance include:
  • Bodily Injury
  • Property Damage
 



 
Bodily Injury
 
 
Bodily injury liability is coverage that helps you pay for another (not-at-fault) person’s injuries in a car accident for which you are found to be at fault.

Liability Limit for Bodily Injury per Person
The per-person limit is the maximum amount that the insurance company will pay out for each individual (not-at-fault) who has been injured in an accident.

Liability Limit for Bodily Injury per Accident
The liability limit per accident is a financial cap for the total amount that the insurance company will pay in total for all of the individuals involved in an accident. In other words, the limit covers all of the medical expenses for those injured (not-at-fault) in an accident by the at-fault driver’s policy, but only up to the preset limit. Any medical expenses incurred that's above and beyond the stated per accident limit would need to be paid by the at-fault driver and/or registered owner of the vehicle.

 



 
Property Damage
 
 
Property damage liability helps cover costs of repairing the vehicle(s) of the other (not-at-fault) drivers involved in the accident, but not your insured vehicle. Property damage liability will also cover repairs from damage done to other property, like structures, such as a house or fence.

Liability Limit for Property Damage
This limit is the maximum amount of coverage paid for damage done to a property. Any costs that exceed the limit would be out-of-pocket expenses for the at-fault driver and/or registered vehicle owner.
 



 
Example of Automobile Liability Insurance
 
 
Let's say an insured motorist had only the minimum Compulsory Auto Insurance Coverage. That provides the following limits:
     Bodily Injury: 10,000 per person / Max 20,000 per accident
     Property Damage: 10,000 per accident

The insured gets into an accident involving multiple people and is ruled at-fault for any and all damages.


Example 1:
  • Person A (Not-at-fault) has injury costs totaling $5,000
  • Person B (Not-at-fault) has injury costs totaling $4,000
  • Person C (Not-at-fault) has injury costs totaling $9,000
  • Person A, B & C (Not-at-fault) have damages to their vehicles totaling $9,000
The at-fault driver would be fully protected, since each person that was injured in the accident had injury costs that were less than $10,000 each. Also, the total amount of the costs for the injuries of everyone involved (except the at-fault driver) was $18,000, which is less than the per-accident bodily injury limit of $20,000.


Example 2:
  • Person A (Not-at-fault) has injury costs totaling $15,000
  • Person B (Not-at-fault) has injury costs totaling $4,000
  • Person C (Not-at-fault) has injury costs totaling $9,000
  • Person A, B & C (Not-at-fault) have damages to their vehicles totaling $26,000
The at-fault driver would be NOT BE FULLY COVERED
  • since one person that was involved in the accident had injury costs that were more than the $10,000 per person limit. The at-fault driver could be liable for the $5,000 over the $10,000 limit;
  • the total amount of the costs for the injuries of everyone involved (except the at-fault driver) was $28,000, which is more than the per-accident bodily injury limit of $20,000. The at-fault driver and/or vehicle registered owner, would be liable for any amount over the limit of $20,000.; and
  • the total costs for damages to the not-at-fault drivers’ vehicles total $26,000. More than the $10,000. Per accident Property Damage limit. The at-fault driver and/or registered vehicle owner, would be liable for this excess $16,000.
 



 
Please consult your CSR today and review multiple scenarios with them to fully understand the extent of your automobile liability coverage. You may find out that it might be advisable to purchase a higher coverage that better protects you.
